For Americans concerned that so-called “red flag laws” which empower courts and police to confiscate a citizen’s duly-owned firearms without compensation or due process are going to get out of hand, a recent case in Oregon will add fuel to those concerns.
Shane Kohfield, a former Marine, has had his firearms taken away by the FBI using Oregon’s red flag law after threatening to “slaughter Antifa” in self-defense.
In July, Kohfield stood outside the home of uber-liberal Portland Mayor Ted Wheeler wearing body armor and an iconic red “Make America Great Again” cap with a very large knife strapped to one shoulder and a copy of his concealed carry license on the other.
As reported by The Oregonian, he used a loudspeaker to warn conservatives who were arriving to take part in a demonstration condemning the Left-wing city’s recent violent demonstrations compliments of hoodlums associated with “Antifa” that they needed to protect themselves.
“If Antifa gets to the point where they start killing us, I’m going to kill them next,” said Kohfield, 32, clearly outlining that he would be acting in self-defense. “I’d slaughter them and I have a detailed plan on how I would wipe out Antifa.”
That was viewed as a threat by locals and, unfortunately, the FBI, which prompted the bureau — via the Joint Terrorism Task Force — to “take a series of extraordinary steps against Kohfield, including temporary seizure of a cache of his firearms under Oregon’s new ‘red flag’ law aimed at preventing gun violence,” the paper reported.
Notice how Left-wing media always call a collection of firearms a ‘cache’ because, you know, that sounds much more menacing.
In any event, the paper noted further that the bureau had Kohfield committed for 20 days to a veteran’s hospital in Portland for ‘evaluation,’ adding insult to injury.
The paper added:
The moves came as city officials and law enforcement prepared for potentially violent clashes Aug. 17 during a right-wing rally and counterprotests planned in downtown Portland that had become inflamed with incendiary political rhetoric nationwide. Police worried that they would end in catastrophe.
Mind you, Kohfield was never charged with a crime, much less convicted of one. He had his guns taken from him, a blatant violation of the Second Amendment’s ‘infringement’ clause and the Fifth Amendment’s “due process” clause — and yet liberals are cheering because it’s gun-related.
What’s more, the city and the bureau violated his First Amendment right to peaceably assemble by banning him from attending the rally event. (Related: Graham announces ‘bipartisan’ bill to ‘fund’ state ‘red flag laws’ in wake of dual mass shootings in El Paso, Dayton.)
“Clearly, this latest incident shows how effective proactive policing can be in reducing the chance of violence,” said Michael German, a retired FBI agent and current fellow at the Brennan Center for Justice at New York University Law School — where, apparently, they don’t teach the Constitution.
“It also makes you wonder if they’d been proactive from the beginning whether all of this would have grown into the menace it has become,” he added.
He has a point there — that is, if he’s talking about the violence committed regularly by members of Antifa, who never have their guns taken from them or wind up charged with a crime.
Medical records show that Kohfield suffers from bipolar disorder and post-traumatic stress disorder. But after returning home from his forced VA incarceration, he explained he wasn’t intending on committing any violence as a first measure.
“I looked unhinged. I looked dangerous and I have the training to be dangerous,” he explained.
Fair enough. But you’ll notice that our Constitution doesn’t come with qualifiers like “only if authorities think you’re mentally healthy.” This man hadn’t hurt anyone, hadn’t committed any crimes, and still had several of his basic constitutional rights violated.
These red flag laws will be used to confiscate more guns under the false impression that it’s “legal.” Hide and watch.
